What is my case worth?

Competent lawyers won’t be able to answer that question until they have a lot of information about the nature of your claim, the prospects of success and the seriousness of your injuries.  But we do our best to give you a general idea.

How long will my case take?

Each case is different.  The length of time depends on some of the following factors:-

  1. The state of your injuries. For example, if you need surgery it is usually unsafe to attempt to resolve your claim until after the surgery.
  2. How soon the insurer is willing to pay you properly for your injuries.

What if my case is unsuccessful, do I still have to pay you?

No.

Will other people know that I am making a claim?

Not if we can help it!  The fact that you are a client of ours remains confidential, except for the purposes of dealing with your claim.  This is one of our professional obligations as lawyers.

Will I have to go to Court?

Most claims resolve in conference or at mediation rather than go to hearing. We start by notifying your claim and issue court proceedings in a timely manner to protect your interests.  If the insurer is not prepared to pay what your claim is worth, we will see them in Court!

Can I run my own claim?

Yes, but most self-represented claimants are at a severe disadvantage.  They lack the necessary knowledge and experience to fully realise the value of their claim.

Do I have to pay you along the way?

No. We only get paid if your case is successful and we wait until the money comes in.

What percentage do you charge?

Australian laws don’t allow lawyers to charge a percentage of what you get – unlike in the USA.

Will I have to pay money upfront?

No. We will pay all the expenses for running your case.

Does the insurance company cover your fees?

If your claim is successful, the insurance company usually has to pay most of your legal costs and disbursements.

What if the legal costs are more than the compensation?

We reduce our costs substantially to make sure you get most of the money.
